Welcome to Bandami. By accessing or using our website, application, and AI-powered IELTS preparation services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Important: Bandami is an independent practice and study tool. It is not affiliated with, endorsed by, or a substitute for the official IELTS examination administered by Cambridge University Press & Assessment, IDP IELTS, or the British Council. Band scores provided are AI-generated estimates and do not represent official IELTS scores.
You must be at least 13 years old to use the Service. If you are under 18, you must have a parent or guardian's consent. By registering, you represent that you meet these requirements.
You must provide accurate and complete information when creating your account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
You may register using email and password, or through Google OAuth. When using Google OAuth, you authorize Google to share your name and email address with Bandami.
Bandami offers free and paid subscription tiers. Details of each plan are displayed on our pricing page and may change with notice.
Free Tier: Includes unlimited practice with basic AI evaluation and band score feedback.
Pro Tier: Unlocks enhanced AI evaluation with detailed analysis and personalized recommendations.
Payment Processor: All payments are processed by Polar.sh. Polar.sh is the Merchant of Record for all transactions. This means Polar.sh handles payment processing, tax collection and remittance, chargebacks, and refunds on behalf of Bandami. By subscribing, you agree to Polar.sh's Terms of Service and Privacy Policy. Bandami does not store full payment card details.
Subscriptions auto-renew at the end of each billing period until canceled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refund requests are handled by Polar.sh in accordance with their refund policy and applicable law.
Bandami uses third-party AI services to evaluate your writing and speaking submissions and generate feedback. You acknowledge that:

Bandami Content: The Service itself — including its name, logo, design, code, and proprietary algorithms — is owned by Bandami and protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the Service without permission.
Your Content: You retain ownership of the essays, audio recordings, and other materials you submit ("User Content"). By submitting User Content, you grant Bandami a worldwide, non-exclusive, royalty-free license to process, store, and display it solely for the purpose of providing the Service to you. Bandami does not use your submitted writing or speaking samples to train AI models unless you explicitly opt in.
AI-Generated Feedback: The evaluations, scores, comments, and corrections generated by the Service are considered part of the Service and may be stored and displayed to you. You may use this feedback for personal educational purposes only.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

Each third-party service has its own Terms of Service and Privacy Policy. Bandami is not responsible for the practices or content of third-party services.
To the fullest extent permitted by law, Bandami and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to:
Bandami's total liability for any claim arising from the Service shall not exceed the amount you paid to Bandami in the 6 months preceding the claim, or USD $50 if you have not made any payments.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Bandami does not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content is inherently probabilistic and may vary between evaluations.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us.
We may modify these Terms at any time. If we make material changes, we will notify you via email or through the Service. Continued use after changes become effective constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Republic of Chile. Any disputes shall be resolved in the courts of Santiago, Chile.
